Terms of Service

1. Acceptance of Terms

By downloading, installing, or playing Starby ("the Game"), you agree to these Terms of Service. If you disagree with any part, please do not use the Game.

2. About the Service

Starby is a mobile puzzle game developed by Stanisław Pawluczuk, operating as a sole proprietorship under Polish law. The Game combines tile-dropping mechanics with 2048-style number merging in a unique, timed puzzle experience.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use Starby for your own personal, non-commercial entertainment. This license does not transfer any ownership rights to you, and all rights not expressly granted are reserved. This license terminates automatically if you materially breach these Terms, or when you delete the app.

4. Age Requirements

• Starby is a mixed-audience game rated 4+ and suitable for all ages
• On first launch, we use a neutral age screen to determine age-appropriate experiences
• Users who choose Under 16 or Prefer not to say, or who are otherwise treated as children/protected users under applicable law, receive a protected experience with limited data collection, no personalized ads, no tracking prompt, and no push notification opt-in
• Because we do not require children or protected users to provide personal information in this mode, verifiable parental consent is not required for ordinary gameplay
• Parents are responsible for monitoring children's use and may contact us with questions about data and safety

5. User Accounts

5.1 Account Creation

• Accounts are optional but required for leaderboard participation
• You may create one account per person
• Usernames must not be offensive, impersonate others, or violate trademarks, as determined in our sole discretion
• We reserve the right to reject, reset, or anonymize usernames and to remove users from leaderboards at any time without terminating their account

5.2 Account Security

You are responsible for maintaining the security of your account. We are not liable for unauthorized access resulting from your failure to protect your credentials.

5.3 Account Deletion

You may delete your account at any time via the in-app Settings. Deletion is irreversible. Upon deletion, you will permanently lose access to all game progress, leaderboard placements, earned items, and consumed Virtual Currency. Non-consumable purchases (such as "Remove Ads") can still be restored via the app store. No refunds will be provided for items lost due to account deletion.

6. Virtual Currency, Items, and Purchases

6.1 Virtual Currency (Coins)

• Coins can be earned through gameplay, rewarded ads, in-game events, or promotions, or purchased with real money
• Coins have no real-world monetary value and cannot be exchanged, transferred, sold, redeemed, or cashed out
• Coins are consumable items — they are depleted upon use and cannot be recovered via the app store's "Restore Purchases" feature
• Your Coin balance is part of your game save and may be preserved via cloud backup if enabled

6.2 Cosmetic Items (Skins)

• Some cosmetic items are purchased directly with real money (non-consumable) and can be restored via the app store on the same platform account
• Some cosmetic items are unlocked using in-game Coins — these are tied to your save data and cannot be restored via the app store, even if you originally purchased the Coins with real money

6.3 Virtual Property License

You do not own Virtual Currency or Cosmetic Items. You receive a limited, personal, non-transferable, revocable license to use them within the Game. We reserve the right to manage, modify, rebalance, or remove Virtual Currency and Cosmetic Items, including adjusting prices, rewards, and game mechanics, at our discretion. We will not do so in a way intended to devalue completed purchases without reasonable justification. Nothing in these Terms removes your mandatory consumer rights under applicable law.

6.4 In-App Purchases

• Prices are displayed in your local currency within the Game
• Purchases are processed by the platform where you downloaded the app (e.g., Apple App Store)
• Except as required by applicable consumer law or your app store's refund policies, all purchases are final
• Refund requests must be directed to the platform where the purchase was made (e.g., reportaproblem.apple.com for iOS)

6.5 In-Game Events and Golden Tile Cup

• Starby may run monthly in-game events such as Golden Tile Cup, where eligible players compete on an event leaderboard during the event period.
• Golden Tile Cup rewards are non-cash in-game Coins only. No purchase is required to participate or to receive an event reward.
• Unless different rewards are displayed in the Game for a specific event, Golden Tile Cup rewards are: 1st place: 1,000 Coins; 2nd place: 500 Coins; 3rd place: 250 Coins.
• Event rewards may be granted automatically after final verification. We may delay, adjust, or withhold rewards to investigate cheating, technical errors, duplicate accounts, bots, exploits, or other abuse.
• Leaderboards and event results may be corrected if there are errors, outages, fraud, or suspicious activity. We may suspend, disqualify, or remove players who manipulate gameplay, scores, ads, purchases, device state, or network traffic.
• Event schedules, eligibility rules, rewards, and availability may change, but we will not treat non-cash event rewards as cash, gambling, betting, sweepstakes, or lottery prizes.

7. Acceptable Use

You agree NOT to:

• Cheat, hack, or exploit bugs for unfair advantage
• Use automated systems (bots, scripts) to play
• Manipulate leaderboards, Golden Tile Cup/event rankings, rewards, ads, purchases, device state, or network traffic
• Reverse engineer, decompile, or modify the Game
• Share exploits publicly instead of reporting them
• Harass, threaten, or abuse other players
• Submit false or fraudulent refund claims
• Violate any applicable laws or regulations

8. Intellectual Property

All content in Starby — including but not limited to graphics, music, code, and game mechanics — is owned by Stanisław Pawluczuk or licensed to us. You may not copy, modify, distribute, or create derivative works without written permission.

9. User Content

By submitting usernames or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the Game's services (e.g., leaderboards).

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from claims, damages, and reasonable costs arising from your violation of these Terms, your misuse of the Game, or your infringement of a third party's rights. This section does not require you to indemnify us for anything that cannot lawfully be imposed on consumers under mandatory consumer protection law in your country of residence.

11. Termination

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in cheating or fraudulent behavior
• Abuse other users or our systems
• Exploit refund mechanisms to obtain free virtual currency or items
• Manipulate or abuse Golden Tile Cup, leaderboards, or reward systems

Upon termination, you lose access to your in-game account, progress, and consumable items (such as Coins). Non-consumable purchases tied to your app store account (such as "Remove Ads") may still be accessible via the app store, but no refunds will be provided. We may also restrict or remove your leaderboard participation.

12. Disclaimers

THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

• Uninterrupted or error-free service
• Compatibility with all devices
• Preservation of game progress in all circumstances

12.1 Third-Party Advertisements

The Game features third-party advertisements, including optional rewarded videos you may choose to watch. We are not responsible for third-party ad content. We do not guarantee the availability of ads or the delivery of rewards if an ad fails to load or is closed prematurely. Using automated tools, macros, or ad blockers to manipulate ad views is strictly prohibited and may result in account suspension.

12.2 Service Changes

We may update, modify, or discontinue features of the Game at any time, including adjusting prices, rewards, game mechanics, and the virtual economy. We will endeavor to give reasonable notice for material changes. Nothing in this section overrides your mandatory consumer rights under applicable law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we are not liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or goodwill
• Damages exceeding amounts you've paid us in the past 12 months

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or intentional misconduct, or any other liability that cannot be excluded or limited under applicable law (including the EU legal guarantee of conformity for digital content under Directive 2019/770).

14. Governing Law

These Terms are governed by the laws of Poland. For EU consumers, mandatory consumer protection laws of your country of residence also apply. Disputes shall be resolved in the courts of Poland, unless you're entitled to your local courts under consumer protection laws.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Game, and supersede any prior agreements on this subject.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will remain in full force.

15.3 No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that or any other provision later.

15.4 Assignment

We may assign our rights and obligations under these Terms, including in connection with a merger, acquisition, or sale of assets. You may not assign your rights under these Terms without our prior written consent.

15.5 Language

Where these Terms are provided in a language other than English, the English version prevails in the event of any conflict, except where prohibited by applicable law.

16. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide reasonable advance notice via an in-app notification. For users in the EU/EEA/UK, material changes require your active acceptance. If you do not agree to the updated Terms, you must stop using the Game.
